Terms and Conditions

 

These are the terms and conditions of CAIRNS REEF FISHING AND CHARTER PTY LTD hereinafter referred to as Cairns Reef Fishing. These terms and conditions apply to all bookings either directly with us or booked through an Agent.

All passengers of Cairns Reef Fishing must read these terms and conditions and complete the waiver form before the vessel departs. The waiver form will be provided on the day to complete. If you have any queries or would like to view the waiver do not hesitate to contact us at [email protected].

BOOKING POLICY

Shared Charters – to secure your booking for a shared charter, payment must be made in full.

Private Charters – a 50% deposit is required for our private charters to secure a booking and no tentative bookings will ‘confirmed’ or ‘secure’ until the 50% deposit is made. Bookings are not held until the deposit is made.

Full payment is required 7 days prior to departure for all booked seats. Any outstanding balances are due for payment 7 days before the charter leaves (charter date) and any outstanding balances will be required 7 days prior to charter date. Outstanding balances will be charged to the credit card provided in the booking, if payment has not been received.

A Tax Invoice or receipt will only be forwarded upon request.

Gift Card numbers must be given at the time of booking otherwise they will not be accepted.

Cairns Reef Fishing will contact all passengers the evening prior (approx. 4pm to 6pm) to their booking to re-confirm all trips.

All bookings are subject to minimum passenger numbers and suitable weather conditions. NB. Rain is not considered bad weather.

If passengers are travelling from a long distance, it is a good idea to check with us prior to departure for a trip update.

Any liability of Cairns Reef Fishing is limited to that of the charter fare paid by the passenger. Cairns Reef Fishing accepts no responsibility for passenger/s personal effects.

If a person becomes unwell and requests to be returned back to shore, please note that no refund will be given, and it is also up to the Skipper’s discretion whether or not to return to port.

Any fishing rods, reels or equipment that are lost overboard or damaged in any way due to customer negligence must be paid for by the customer before leaving the boat.

In the event the trip is cancelled at any time by Cairns Reef Fishing, we will not be held liable for any indirect costs i.e. travel costs, meals, accommodation or any other costs the customer may have incurred, as a result of booking with us.

All passengers of Cairns Reef Fishing must read the waiver terms and conditions and complete the waiver form before the vessel departs. A waiver will be provided on the day of the charter to complete. A copy of the waiver can be provided prior to charter upon request.

DAMAGE TO EQUIPMENT AND VESSEL

The passenger/s agree to be responsible for any damage to fishing equipment or the vessel caused by their actions or negligence. In the event of such damage, the customer will be required to cover the costs of repair or replacement as determined by Cairns Reef Fishing. The approximate cost for replacing a damaged rod and reel is $500.

RESCHEDULING

Bookings can be rescheduled provided the request is made 7 days prior to the scheduled charter date.

GIFT CARDS

Gift Vouchers expire 3 years from date of issue and cannot be extended.

Gift Vouchers are not redeemable for cash or refundable under any circumstances. If your charter is cancelled by Cairns Reef Fishing due to weather (or any other operational reason), you can reschedule to another date.

If the customer is eligible for a rescheduled charter and has booked using a gift card/s, the associated gift card/s will be un-redeemed and remain valid until the original expiry date.

If the customer is not eligible for a reschedule, associated gift card/s will be redeemed/cancelled.

If a charter is cancelled by Cairns Reef Fishing due to weather, the gift cards will be made valid again until the original expiry date.

REFUNDS

Refunds can only be obtained from an Agent when aspects of the Safety and Weather policy apply (see policy further below) and only after they have sought confirmation and authorisation from Cairns Reef Fishing. Note: Refunds do not apply in any circumstance to gift cards, or any booking/s made with a gift card.

Off-shore trips are pending on weather conditions. If inclement weather conditions prevail, it is up to the Skipper’s discretion as to whether the trip will proceed. In the event the charter is cancelled by Cairns Reef Fishing, you may nominate a full refund of deposit or transfer your deposit to an alternative date if your trip has been cancelled due to weather (or any other operational reason).

All trips are refundable if we, Cairns Reef Fishing, cancel or reschedule the trip. (Refunds do not apply to gift cards).

Please note that refunds can take up to 14 days to appear on your bank statement. This period allows for the necessary processing time by both our payment processor and your financial institution.

CANCELLATION POLICY

More than 7 days prior to booking/charter date:
Any cancellations or changes requested with a minimum of 7 days’ notice are eligible for a full refund, credit or to reschedule. No fees apply. (Refunds in these circumstances do not apply to gift cards).

Less than 7 days day prior to booking/charter date or ‘no shows’:
If a cancellation is made less than 7 days prior to a booking, or the customer does not attend on the day (‘no show’), the customer will not be eligible for a refund or credit and gift cards will be redeemed/cancelled. Any outstanding monies will be charged in full.

CANCELLATION COMMUNICATION

Cancellations must be made directly with Cairns Reef Fishing, by phone (0427 400 027) or email ([email protected]). The customer is responsible for ensuring the cancellation has been received and responded to by Cairns Reef Fishing.

MINIMUM OPERATING NUMBERS CANCELLATION

Cairns Reef Fishing have a minimum operating number of passengers required. In the rare event the minimum has not been met, a cancellation email will be sent, and the customer will have the choice to reschedule or receive a refund and/or gift cards to be made valid again. (Refunds do not apply to gift cards).

CUSTOMER BEHAVIOUR
It is required that all customers behave in a safe and respectful manner to all staff, other customers and Cairns Reef Fishing property.

If we find that there has been loss or damage to our equipment or vessel due to negligence or unruly behaviour, then the customer will be liable for replacement or repair of the item (funds will be taken from the credit card that is held for security).

The Skipper reserves the right to cancel a trip and payment forfeited if unruly or unsafe behaviour is displayed.

SAFETY AND WEATHER POLICY

Charters are not affected by rain, but strong winds and big swells may result in cancellation of a charter.

Marine weather forecasts can change during the day and overnight. We will endeavour to inform you via text or phone and email if any decision to cancel a charter is made. Please ensure your phone is switched on.

In an instance where the weather may turn unexpectedly it is at the discretion of the Skipper as to whether any, a full, or part refund is given.

Children under the age of 15 must be accompanied by an adult and become their responsibility whilst on board the boat.

All customers must declare any pre-existing medical conditions or any medication prior to departure (as some people may require special attention).

We have the right to ask any customer to wear a life jacket at any time.

ALCOHOL CONSUMPTION POLICY

Whilst we want everyone to relax and have a great time on our charters, safety is our priority, and we are required by our insurers to ensure that the following conditions are acknowledged and adhered to:

Only mid strength drinks (cans no glass) in a reasonable quantity will be allowed on board. We consider a reasonable quantity to be a maximum of around 8 cans per passenger or a maximum of four (4) x Thirty (30) pack cartons per charter.

If passengers bring drinks on board that are full strength or in excess of this reasonable amount the charter will be cancelled, the boat will return to port and no refunds will be given.

If passengers arriving at the boat are clearly inebriated or under the influence of drugs, they will not be allowed to board and no refunds will be given.

The skipper has the authority to ban drinking alcohol at any time to enable a safe boating situation to be maintained for all on board. If you breach this policy and an early return to shore results from unruly behaviour you will be liable for compensation to the other passengers on the boat and will receive no refund. Private charters will not be entitled to any refund.

HANDLING UNDERSIZED, OVERSIZED, NO-TAKE, OR CLOSED SEASON SPECIES

By joining our fishing charters, you agree to:

1. Follow Queensland Regulations: Adhere to all size limits, no-take rules, and seasonal closures.

2. Immediate Release: Return any undersized, oversized, no-take, or out-of-season fish to the
water immediately.

3. Handle with Care: Use proper techniques to ensure fish survival.

4. Obey Crew: Follow all crew instructions for fish handling and release.

5. Fish Processing: Due to Fisheries Queensland regulations, we are unable to fillet customer catches. However, we will gut and gill the fish for you.

Legal Obligations: Non-compliance may result in penalties under Queensland law and may lead to the termination of your participation without a refund. You will be personally liable for any fines.

Cairns Reef Fishing reserves the right to alter Terms and Conditions and Pricing without notice.
